Ultimate Pilates - Terms and Conditions

1. Length of Contract

(a) In the instance of a Studio session the contract period between Ultimate Pilates and the client is limited to the length of that sole session, the client remits only for the cost of that class and has no liability for any extended period.
(b) where a term of classes has been booked the booking is made between Ultimate Pilates and the client for a period of one term, the definition of a term is a number of consecutive classes that form the length of a term. In general a term is made up of 6 consecutive sessions at a frequency of 1 per week, however some terms may not be 6 weeks in length. At all times the length of the term will be conveyed to you prior to you booking and paying. Once this term has expired there is no longer a contract in place to supply a service between Ultimate Pilates and the client unless you decide to rebook for the next consecutive term.

2. Payment for Classes

(a) Payment for Studio sessions will be made at the beginning of each session, once payment has been made no refunds will be available for the service to the client.
(b) Payment for all classes will be made no earlier than one week prior to the start of the contract period or Term, any failure to remit in full before the commencement of the contract period will render the contact null and void, this may only be revoked at our discretion. Signing the rebooking sheet at class,  replying to any email communication affirmatively, or booking on to the next term via any electronic portal offered by Ultimate Pilates constitutes a new contract between Ultimate Pilates and the client and failure by the client to take up the place will result in Ultimate Pilates requiring payment.

3. Holiday Amnesty

Holiday amnesty allows you two weeks a year where you don't have to pay for your classes if you are on Holiday or another unmissable event, but will still ensure that you do not loose your place for the following term. The Holiday amnesty period runs from 1st July till the 30th June each year. Dates must be provided to us before the start of the term that they will apply to.

4. Health and Suitability

Ultimate responsibility in assessing the suitability and safety of any class, session or exercise must rest upon the client. Ultimate Pilates will endeavour to ensure the client has completed the relevant health questionnaire, if any questions have been answered "yes" the responsibility lies with the client to obtain any necessary professional approval for the suitability of any exercise regime undertaken. It is the responsibility of the client to update and inform Ultimate Pilates of any changes in their specific or general health conditions that may or may not effect the suitability of any exercise regime entered into.

5. Cancellation Policy

(a) The studio operates a strict 24 hour notice of cancellation otherwise full payment will be due.
(b) There are no refunds of classes missed by the client and making up the classes elsewhere in our timetable is at the sole discretion of Ultimate Pilates but will not generally be witheld. Where a term of classes has been booked and the client fails to make payment or changes their mind, payment in full will still be due if notice of termination from the client is not received prior to the start of the said term..

6. Your Data and our Privacy Policy

This privacy policy sets out how Ultimate Pilates Limited and Gailedean Limited uses and protects any information that you give Ultimate Pilates Limited and Gailedean Limited when you use this website or use our services or products.

Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

(a) What we collect
We may collect the following information:
• Name and Address
• Contact information including email address
• Health information • None of the personally identifiable information that we collect via user submitted forms is shared with third parties, with the exception of payments that go to our merchant providers payment gateway.
• Merchant providers that we use may collect payment information from you at time of purchase of a service or product.

(b) What we do with the information we gather
We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:
• Internal record keeping.
• Processing your account in accordance with the products or services that you are subscribed to.
• Health information is only used to ascertain the suitability of any products or services we offer, this is to ensure that you are fit to attend and that we comply with our insurance prerequisites.
• We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
• From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, or mail. We may use the information to customise the website according to your interests.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

(d) How we use cookies

Ultimate Pilates Limited and Gailedean Limited will retent your data for no longer than is reasonably necessary after you terminate any contracts or serv ices with us, all or part of your data may fall under the scope of a statutory period of records retention governed by UK authorities, if this is the case we will adhere to those periods.

(f) Controlling your personal information
We will not sell, distribute or lease your personal information to third parties. We will not use your personal information to send you promotional information about third parties. You may request details of personal information which we hold about you under the Data Protection Act 1998. If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible. We will promptly correct any information found to be incorrect.
